Terms & Conditions

Payment is due upon completion of work unless otherwise stated in writing. For equipment installations, payment is due immediately upon substantial completion of the installation. A 3.5% processing fee will be added to all payments made by credit or debit card. Payments made by cash, check, or ACH are not subject to this fee.

Past-due balances may be subject to a finance charge of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.

A $35.00 fee will be charged for any returned check, insufficient funds (NSF) payment, or stop-payment order.

Customer agrees to pay all reasonable collection costs, attorney's fees, court costs, and expenses incurred by MTS Mechanical in collecting unpaid balances.

All materials supplied remain the property of MTS Mechanical until paid in full.

Quoted prices are based on the scope of work described. Any additional work requested by the customer, unforeseen conditions, code-required modifications, or customer-requested changes may result in additional charges.

Customer is responsible for providing safe and reasonable access to all equipment and work areas. Additional charges may apply if access restrictions increase labor time or require return visits.

MTS Mechanical warrants workmanship for one (1) year from the date of installation unless otherwise stated in writing. Manufacturer warranties on equipment and materials are subject solely to the manufacturer's terms and conditions.

Warranty coverage does not include failures caused by misuse, neglect, lack of maintenance, power surges, acts of nature, vandalism, unauthorized repairs, or conditions beyond MTS Mechanical's control.

Any service call determined to be unrelated to the original repair or installation may be billed at current labor and material rates.

Customer shall inspect all work upon completion and notify MTS Mechanical of any concerns within ten (10) days. Failure to do so shall constitute acceptance of the work performed.

MTS Mechanical reserves all mechanic's lien, materialman's lien, and bond claim rights for labor, materials, equipment, and services furnished. Failure to make payment when due may result in the filing of a lien against the property and/or other legal remedies available under applicable law.

For projects requiring permits and inspections, final inspections, permit closeouts, warranty registration, and project completion documentation may be withheld until all outstanding balances are paid in full. Any costs associated with rescheduling inspections due to non-payment shall be the responsibility of the customer.

MTS Mechanical shall not be liable for incidental, consequential, special, or indirect damages, including loss of use, loss of profits, or property damage beyond the direct cost of the services provided.

By accepting the services described on this invoice, the customer acknowledges and agrees to these Terms & Conditions.
